DJ Request Terms of Service

By using DJ Request (the “App”), you (“DJ”) agree to these Terms of Service. The App enables guests to submit song requests to your session. Payments are processed by Stripe on your connected account; you are the merchant of record for accepted (captured) transactions.

These terms apply to your DJ account and each session you run.

• You must have the legal right to perform at your venue and to accept payments where you operate.
• You are responsible for account security and ensuring your session settings (price, display name) are accurate.
• You must keep your Stripe connected account information complete and up to date.

• Guests authorize a temporary hold for your current request price (the base amount, in USD).
• Guests may optionally add a tip at checkout. Boosts are separate from the base.
• Accept → the hold (and any tip) is captured (charge completes). Decline → the hold is released (no charge).
• Uncaptured holds auto-expire after a period shown in your dashboard; expired holds are released back to the guest.
• Requests priced at $0.00 (e.g., during a free trial or free session) do not result in a charge and incur no fees.
• You are responsible for timely fulfillment of accepted requests during your session.
• The App may auto-cancel stale items for safety; such cancellations do not charge guests.

• You set your request price (subject to the in-app minimum). Guests see this before authorizing a hold.
• Platform fee (App): 15.00% applies to each paid, accepted request, calculated on the base amount only. No platform fee applies to tips.
• Stripe processing: 2.9% of (base + tips) plus a fixed $0.30 per successful paid capture. Stripe fees do not apply to free/zero-amount or declined requests.
• Payout timing and availability are governed by Stripe and your connected account’s capabilities/compliance.
• Dashboard “estimated payout” figures are informational and may differ due to taxes, rounding, adjustments, refunds, or disputes.

• During the DJ free trial (up to 30 days), guest requests may be submitted without payment.
• Accepted requests during the trial do not generate charges and incur no platform or Stripe fees.
• When the trial ends, new requests require payment authorization; existing holds/requests follow normal rules.

• The App offers optional AI song suggestions. When used, the App may transmit non-sensitive music context (e.g., approved track titles/artists and the currently requested track) to an AI provider to generate a recommendation.
• You must be 18 or older, use a verified email, and have an eligible trial or paid plan to use AI. Trial and paid usage limits apply, and access may be suspended or reduced to prevent abuse or control service costs.
• When Gemini is unavailable or a safety limit is reached, eligible accounts may receive a clearly labeled local queue suggestion instead. Free, expired, and trial-exhausted accounts do not receive that fallback.
• The App may query public music metadata/artwork services to display album art for suggested tracks.
• AI output may be inaccurate, unavailable, or unsuitable. You agree not to rely on it for rights-clearance, availability, or safety decisions; you remain responsible for every selection.

• Guests may upload photos to display on your event’s Photo Wall. You control visibility and may remove content at any time.
• Event photo files and records are deleted no later than 30 days after upload unless included in an album.
• Created albums and their photo files are deleted 90 days after album creation.
• You agree to moderate content and remove anything unlawful, infringing, or inappropriate for your venue.
• We may remove content at our discretion to comply with law or platform policies.

• Web-push notifications require user permission and may require installing the App to your Home Screen on iOS.
• Delivery of notifications is not guaranteed and may be affected by device settings, battery optimizations, or network conditions.

• Declined or expired requests are not charged; holds are automatically released.
• For captured transactions, chargeback disputes are handled in Stripe on your connected account.
• You are responsible for responding to disputes and supplying evidence through Stripe where applicable.
• DJ Request is not liable for venue issues, guest behavior, or availability/licensing of specific tracks.

• No illegal, hateful, infringing, or pornographic content. Respect venue rules and local laws.
• Comply with copyright/performance rights as required by law or your venue.
• No misuse of the App (fraud, spam, attempts to bypass fees or Stripe processes, reverse engineering, etc.).

The App stores data necessary to run your session (e.g., requests, DJ profile, totals, Photo Wall metadata). Payment data is processed by Stripe; review Stripe’s terms and privacy for payment compliance details. We may use third-party services (e.g., Firebase, AI recommendation APIs) to store or process operational data per their terms.

• Features, pricing, and integrations (including Stripe and AI providers) may change at any time.
• The App may be unavailable due to maintenance, provider outages, or events beyond our control.

• To the maximum extent permitted by law, the App is provided “as is” without warranties, and our aggregate liability related to your use of the App is limited to amounts you paid to us for the service in the three (3) months preceding the claim.
• These terms are governed by the laws applicable in our place of incorporation/operation; venue for disputes will be the courts there, unless Stripe requires otherwise for payment matters.

We may update these terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated terms.
